Event Terms & Conditions
The following are the terms and conditions of participation in the “Choosing Hope” remembrance walk.
I agree, acknowledge and accept that, in consideration for my participation in the Event conducted by Bears Of Hope Pregnancy & Infant Loss Support Inc.:
1. I am over 18 years old and understand that the Event involves walking through natural environments beyond the control of Bears of Hope Pregnancy & Infant Loss Support Inc], which involves inherent risks and hazards associated with walking through such environments, including but not limited to:
a) over-exertion, dehydration and accidents with other participants and spectators;
b) my own negligence and the negligence of others;
c) exposure to the elements for extended periods;
d) exposure to waterways and cliff edges;
e) attack by, or encounter with, insects, reptiles and other animals.
2. I voluntarily assume all risks associated with my participation in the Event or any activity associated with it and will take reasonable measures to protect myself (and those under my supervision) from the risks of participation.
3. I am responsible for all property I bring to the Event and understand that Bears Of Hope Pregnancy & Infant Loss Support Inc. does not accept responsibility for any loss or damage to this property.
4. I warrant that:
a) I will follow all reasonable directions given by Bears of Hope and acknowledge that any misconduct or refusal to following reasonable directions may result in my removal from the Event or otherwise be prevented from further participating in the Event;
b) I will not consume any alcohol or take any drugs or medicines except those which have been prescribed to me and which are taken in accordance with the prescribed directions.
c) I will not engage in any reckless behaviour which endangers other participants, staff members or members of the general public in connection with my participation in the Event.
5. To the extent any persons under the age of 18 years old (child or children) accompanies me to the Event (including in circumstances where I have registered participation on their behalf):
a) I warrant that I have parental responsibility for such persons and I will supervise their participation at all times; and
b) I agree that any such persons is participating in the Event entirely at his or her own risk.
6. To the extent I have registered to participate in the Event on behalf of myself and others over the age of 18 years old (Team Participants), I warrant that:
a) I am authorised to register the participation of the Team Participants on behalf of each Team Participant;
b) I have informed the Team Participants regarding the nature of the Event, including inherent risks and hazards associated with participating in the Event;
c) I agree that any such persons is participating in the Event entirely at his or her own risk;
d) I have, or I will, direct Team Participants to read the full terms and conditions of participating in the Event, including as published by Bears of Hope on its Choosing Hope website.
7. To the fullest extent permitted by law:
a) I waive any and all claims or legal actions that I may have at any time against Bears Of Hope Pregnancy & Infant Loss Support Inc. in connection with the Event, including for any liability, loss or costs arising or may arise at any time, directly or indirectly, from my participation in the Event or from my child’s (or children’s) participation in the Event.
b) I release and hold Bears Of Hope Pregnancy & Infant Loss Support Inc. harmless with respect to any and all injury, disability, death or loss or damage to person or property, whether caused by negligence or otherwise, arising or may arise at any time, directly or indirectly, from my participation in the Event or from my child’s (or children’s) participation in the Event.
c) I will indemnify Bears Of Hope Pregnancy & Infant Loss Support Inc. in conjunction with any injury, disability, death or loss or damage to person or property that may occur as a result of my participation, or my child’s or children’s participation, in the Event.
8. Tickets are non-refundable and non-transferable.
9. The event will not be postponed due to inclement weather.
10. No refunds are provided if event is cancelled for safety reasons.
11. Incentive Orders will not be accepted after the 31st October.
12. Baby/ies details for Bear Tagging must be provided no later than 2 weeks after the closing date of the campaign. After this time, all funds raised will be allocated to the Bears Of Hope General Objectives.
